About these terms

These Terms of Use are an agreement between you and Sparks Support Pty Ltd (ABN 93 669 152 103) for your use of the Sparks Flow website and platform. By creating an account or using Sparks Flow, you agree to these terms. If you do not agree, please do not use the service.

What Sparks Flow is, and is not

Sparks Flow is a software tool that helps Australian families and providers manage their own support workers: participant profiles, rosters, shift messaging, shift notes and worker compliance tracking, with self serve recruitment when you need it.

Sparks Flow is not an employment agency, not a staffing marketplace, and not an NDIS plan manager or registered NDIS provider. We do not employ or supply support workers, and we do not provide legal, financial, employment or NDIS advice. You remain responsible for your own obligations as an employer or engager of workers, and for how you use the information the platform provides.

Eligibility and your account

You must be at least 18 years old and located in Australia to use Sparks Flow. You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at hello@sparksflow.app if you believe your account has been accessed without your permission.

Your data and your responsibilities

You keep ownership of the information you enter. You grant us the permissions needed to host and process it so we can provide the service, as described in our Privacy Policy.

You are responsible for the accuracy of what you enter, and for having the authority and consent to enter other people’s information, including participants and support workers. You are responsible for meeting your own legal obligations, including employment, work health and safety, privacy and NDIS related obligations. Sparks Flow is a tool to help you, it does not assume those responsibilities for you.

SMS messaging

Sparks Flow can send SMS messages to the support workers you roster, for shift requests and end of shift notes. You are responsible for ensuring the workers you add are happy to receive these messages on the numbers you provide. Message frequency depends on how you use the platform.

Subscriptions, billing and trials

Sparks Flow is offered on an annual subscription. New accounts start with a 14 day free trial, with no card required to begin. After the trial, access continues only while your subscription is active. Fees are billed in advance through our payment processor, Stripe.

There are no lock in contracts. You can cancel at any time, and you will keep access until the end of your paid period. Except where required by the Australian Consumer Law, fees already paid are not refundable for partial periods.

Acceptable use

You agree not to misuse the platform, including by attempting to access data that is not yours, interfering with its security or operation, uploading unlawful or harmful content, or using it to break the law or anyone else’s rights.

Intellectual property

Sparks Flow, including its software, design and content, belongs to Sparks Support Pty Ltd. These terms do not give you any ownership of it, only the right to use the service while your account is active.

Availability and changes

We aim to keep the platform available and improving, but we may update, suspend or change features from time to time. We may also update these terms, and will post the updated version here with a new date.

Disclaimers and liability

The platform is provided on an "as is" basis. To the extent permitted by law, we exclude implied warranties and are not liable for indirect or consequential loss. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Where our liability can be limited, it is limited to resupplying the service or refunding the fees you paid for the relevant period.

Termination

You can stop using Sparks Flow and cancel at any time. We may suspend or close an account that breaches these terms. On cancellation, the data handling described in our Privacy Policy applies.

Governing law

These terms are governed by the laws of Queensland, Australia, and you submit to the courts of that state. Questions about these terms can be sent to hello@sparksflow.app.
